SmartSave Easy Limited.("Fygo", "we", "us", or "our") hereby remind you to read and understand these Terms of Use (the "Terms"). This is a legal agreement between you and us which governs your use of fygonas.shop("Site"), excluding sites under their own terms of use. Please read carefully and fully understand the Terms and Privacy Policy ("Privacy Policy") before your use of any service ("Services"). The Privacy Policy, rules on specific services, notices and announcements, etc. are an integral part of these Terms and have the same legal effect as these Terms.

Please read and agree to the Terms before using our Services. By clicking the agree button or by continuing to access or use the Services, you acknowledge that you have read, understood, and expressly agree to be bound by all terms and conditions of these Terms. I.Acceptance of these Terms

These Terms do not alter in any way the terms and conditions of any other agreement you may have with us, or its subsidiaries or affiliates, for products, services or otherwise. Fygo reserves the right to change or modify any of the terms and conditions contained in the Terms, any policy or guideline of the Site, and any and all content contained in the Site or Services offered through the Site at any time without notice and in its sole discretion. Any changes or modification will be effective immediately upon posting of the revisions on the Site, and you waive any right you may have to receive specific notice of such changes or modifications. Your continued use of this Site following the posting of changes or modifications will confirm your acceptance of such changes or modifications. You should frequently review the Terms and applicable policies from time to time to understand the terms and conditions that apply to your use of the Site. If you do not agree to the amended terms, you must stop using the Site.

II.Eligibility

By using the Services, you represent and warrant that: (1) you can legally enter into a binding contract under the laws of your home country; (2) you are legally permitted to use the Services by the laws of your home country; (3) you will comply with these Terms and all applicable local, state, national and international laws, rules and regulations.
You confirm that you are not the subject of trade restrictions, sanctions, legal restrictions and rules limits imposed by any organization, region or country.

In consideration of your use of the Site, you agree to: (a) provide accurate, current and complete information about you as may be prompted by any registration forms on the Site. (b) maintain the security of your password and identification; (c) maintain and promptly update the registration data, and any other information you provide to Fygo, to keep it accurate, current and complete; and (d) accept all risks of unauthorized access to the registration data and any other information you provide to Fygo.

IV.Intellectual Property

All content, including but not limited to trademarks, logos, product designs, technical documentation, imagery, and textual materials (collectively, "Site Materials") displayed on this Site, are the exclusive property of Fygo or its licensors. Unauthorized reproduction, modification, distribution, or commercial exploitation of Site Materials is strictly prohibited.
Trademark Rights:The marks "Fygo", and product names are registered trademarks or trade names owned by us. Third-party trademarks referenced on this Site belong to their respective owners. Access to this Site does not grant any implied license to use trademarks displayed herein without prior written consent from Fygo or the relevant rights holder.
Domain Management:Our official domains arefygonas.shop. We reserve exclusive rights to all domain names incorporating the "Fygo" trademark.
Restrictions on Use

(1) You access to and use of the Service is subject to the Terms and all applicable laws and regulations. You agree not to engage in the following activities:

(2) Reverse engineer, decompile, disassemble, or create derivative works from products;

(3) Use Site Materials for promotional purposes, sales activities, or unauthorized collaborations (e.g., unapproved co-branding);

(4) Modify (or disable) any security, encryption or anti-privacy software or technology included in the Services;

(5) Remove, alter, or obscure trademarks, copyright notices, or proprietary markings on products, packaging, or digital platforms.

Enforcement Against Infringement

(1) In the event of any infringement of Fygo’s intellectual property rights (including but not limited to counterfeiting or design theft):

(2) We reserve the right to immediately terminate the infringing party’s account and terminate access;

(3) We reserve the right to pursue all available legal remedies, including but not limited to injunctive relief and monetary damages, to cease infringing activities.

V.Permitted License Uses

Subject to these Terms, we grant you a non-exclusive, non-sublicensable, personal, revocable, limited license to access and use the Services. The availability and features of our services may vary depending on where you live.
You must not permit, authorise, or assist any other person, to:

(1) remove any proprietary notice language in any copies of such documents;

(2) use such information for your own personal, non-commercial informational purposes and do not copy or post such information on any networked computer or broadcast in any media;

(3) make no modifications to any such information;

(4) use any data mining, robots or similar data gathering or extraction methods;

(5) download (other than page caching) any portion of the Site, the Site Materials or any information contained therein, except as expressly provided on the Site; and

(6) use the Site or the Site Materials other than for its intended purpose. Any use of the Site or the Site Materials other than as specifically authorized herein, without the prior written permission of Fygo, is strictly prohibited and will terminate the license granted herein. Such unauthorized use may also violate applicable laws including without limitation copyright and trademark laws and applicable communications regulations and statutes. Unless explicitly stated herein, nothing in these Terms shall be construed as conferring any license to intellectual property rights, whether by estoppel, implication or otherwise. This license is revocable at any time. Any use of the Fygo software provided to you with a Fygo product or otherwise downloaded from the Site is governed by the Fygo End User License Agreement.

Permitted Fair Use

(1) Limited non-commercial use of proprietary assets (e.g., product reviews, editorial content) is permitted, provided:

(2) Fygo’s ownership is prominently acknowledged;

(3) No endorsement or affiliation with Fygo is implied; and

(4) In accordance with applicable laws and regulations.

VI.Fees

Use of the Service may involve transmission of data through your service provider’s network or from the use of mobile and/or internet, including without limitation SMS, MMS and WAP browsing, data transfer and other services that require the use of airtime and mobile. Your network service provider may charge for such data transmission. Fygo assumes no responsibility for the payment of any charges, and your operator/carrier is in every respect solely responsible for the services it provides to you.

VII.Use of Personal Information

When you are using the Services, we may need to collect personal information to provide you with the Services. We pay great attention to the protection of your personal information and have made the Privacy Policy, which states the detailed information of the way we collect, use, store, transfer, and disclose your personal information.

VIII.Indemnification

You will indemnify, release and hold harmless us, our parent, subsidiaries and affiliates, and all officers, directors, agents and employees thereof, and any party acting on our behalf, from and against any and all third party claims, actions, liabilities, losses, damages, judgments, costs and expenses, including reasonable attorneys’ fees (collectively, "Claims") arising out of (i) any use of the Services or services appearing on the Services by you or by any person you allow to use the Services that is not in accordance with the terms of these Terms; (ii) any breach of these Terms by you or by any person that you allow to use the Services; or (iii) any violation of any laws, regulations or the rights of any third party by you or by any person that you allow to use the Services or services appearing on the Services.

IX.Disclaimer and Limitation of Liability

1.The Services is not compatible with all software and hardware systems. We do not guarantee that the Services will be continuously available or error-free. In the event of incompatibility and errors in the Services, you can contact our technical support team. If there is a compatibility issue that cannot be resolved, you may be required to stop using the Services.

2.To the fullest extent permitted by applicable laws and regulations, we will not be liable (whether in contract, tort (including negligence), or otherwise) for any form of indirect or consequential loss or damage, loss of profits, loss of business, loss of revenue, loss of data, loss of goodwill, loss of opportunity or loss of anticipated savings or any other economic loss arising out of or in connection with these Terms or the Services. To the extent any applicable statutory guarantees apply to the supply of the Services to you under this Terms, our liability under those guarantees shall be limited to (at our option) re-supplying the Services, or paying the cost of that re-supply.

3.To the fullest extent permitted by applicable laws and regulations, with the exception of any liability arising from a statutory guarantee contemplated by clause IX (2), our liability under these Terms is limited to the amounts you paid to us during the twelve months prior to the first claim.

X.Termination

Notwithstanding any of these Terms, Fygo reserves the right, without notice and in its sole discretion, to terminate your license to use the Site, and to block or prevent your future access to and use of the Site.

XI.Governing Law and Dispute Resolution

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the People's Republic of China(for the purposes of these Terms, excluding the laws of the Hong Kong Special Administrative Region, the Macau Special Administrative Region, and Taiwan),without regard to its conflict of law principles.
Any dispute, controversy, difference or claim arising out of or relating to these Terms, including the existence, validity, interpretation, performance, breach or termination thereof or any dispute regarding non-contractual obligations arising out of or relating to it shall be referred to and finally resolved by arbitration administered by the Singapore International Arbitration Centre ("SIAC") in accordance with the Arbitration Rules of the Singapore International Arbitration Centre ("SIAC Rules") for the time being in force, which rules are deemed to be incorporated by reference in this clause.The seat of the arbitration shall be Singapore.The Tribunal shall consist of one (1) arbitrator. The language of the arbitration shall be English. The arbitral award is final and binding upon both parties.

XII.Miscellaneous

If any provision of these Terms is wholly or partially invalid or unenforceable for any reason or is in violation of any applicable law or regulation, that provision is deemed removed and the remainder of the Terms will continue to be valid and binding.
A notice under these Terms must be in writing and given to its recipient entity:

A provision of these Terms, or right, power or remedy created under it, may not be varied, or waived except in writing.
Each party must, at its own expense, do all things and execute all documents necessary to give full effect to this Terms and the transactions contemplated by these Terms.
The rights, powers, and remedies of a party provided in these Terms are cumulative with, and not exclusive of, any right, power, or remedy provided by law.
If the Site contains links to other sites and resources provided by third parties, these links are provided for your convenience only. We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them.
These Terms is prepared and drafted in English but may be translated into other languages. In the event of any conflict between the English version of these Terms and any translation hereof, the English version shall prevail.
